مجازات اعدام در جرائم مواد مخدر یکی از مناقشهبرانگیزترین نمودهای سیاست کیفری معاصر است که در تقاطع ملاحظات امنیتی، ادعاهای بازدارندگی، ضرورت حفظ نظم عمومی و الزامات حقوق بشری قرار دارد. مسئله اصلی این پژوهش آن است که آیا اعدام در این حوزه را میتوان بر پایه نظریههای کلاسیک مجازات توجیه کرد و این مجازات در پرتو تحلیل قدرت در اندیشه میشل فوکو چه معنایی مییابد. پژوهش حاضر با رویکردی توصیفی-تحلیلی و با استفاده از منابع کتابخانهای، در پی آن است که مجازات اعدام در جرائم مواد مخدر را از دو منظر مکمل بررسی کند: نخست، از منظر نظریه مجازات با تمرکز بر مباحثی چون بازدارندگی، تناسب، استحقاق، ضرورت و عدالت کیفری؛ و دوم، از منظر جامعهشناسی کیفری و تحلیل فوکویی قدرت با تأکید بر مفاهیمی چون قدرت/دانش، انضباط، امنیت، حکومتمندی و زیستقدرت. یافتههای پژوهش نشان میدهد که توجیه اعدام در جرائم مواد مخدر از حیث هنجاری با چالشهای جدی مواجه است؛ زیرا شواهد قاطعی در خصوص اثربخشی ویژه آن در بازدارندگی از این جرائم وجود ندارد و تعمیم شدیدترین پاسخ کیفری به طیفی متنوع از رفتارها و مرتکبان با اصل تناسب و فردیسازی مجازات ناسازگار است. همچنین، تحلیل فوکویی نشان میدهد که اعدام در این حوزه صرفاً یک ابزار کیفری نیست، بلکه بخشی از سازوکارهای دولت برای مدیریت خطر، امنیتیسازی مسئله مواد مخدر، تولید سوژه خطرناک و اعمال قدرت بر جمعیت است. بر این اساس، اعدام در جرائم مواد مخدر را باید نه فقط بهعنوان یک نهاد حقوقی، بلکه بهمثابه یک فناوری قدرت تحلیل کرد که در بستر فرهنگ کنترل، سیاستهای امنیتی و نابرابریهای اجتماعی عمل میکند. نتیجه آنکه بازاندیشی در سیاست کیفری مواد مخدر مستلزم فاصله گرفتن از منطق حذفگرایانه و حرکت به سوی رویکردهای عدالتمحور، پیشگیرانه و مبتنی بر اصلاحات ساختاری است.

The death penalty for drug-related offenses is one of the most controversial aspects of contemporary penal policy, situated at the intersection of security considerations, claims regarding deterrence, the necessity of maintaining public order, and human rights imperatives. The central question of this research is whether capital punishment in this domain can be justified based on classical theories of punishment and what meaning this penalty acquires when viewed through the lens of Michel Foucault’s analysis of power. Adopting a descriptive-analytical approach and drawing on library-based research, this study seeks to examine the death penalty for drug-related offenses from two complementary perspectives: first, through the lens of penal theory—focusing on concepts such as deterrence, proportionality, desert, necessity, and criminal justice; and second, through the lens of penal sociology and a Foucaultian analysis of power—emphasizing concepts such as power/knowledge, discipline, security, governmentality, and biopower. The findings indicate that the justification for the death penalty in drug-related offenses faces serious normative challenges; This is because there is no conclusive evidence regarding its specific effectiveness in deterring these crimes, and extending the harshest penal response to a diverse range of behaviors and offenders is incompatible with the principles of proportionality and the individualization of punishment. Furthermore, a Foucauldian analysis reveals that execution in this context is not merely a penal tool but part of state mechanisms for managing risk, securitizing the drug issue, constructing the "dangerous subject," and exercising power over the population. Accordingly, execution for drug-related offenses should be analyzed not merely as a legal institution, but as a technology of power operating within the context of a culture of control, security policies, and social inequalities. Revisiting drug-related penal policy necessitates moving away from an exclusionary logic and toward approaches grounded in justice, prevention, and structural reform.
